You Do Not Need To Be Moving To Be Charged With And Convicted Of DUI
A recent case in New Jersey brings to light a common misconception among the public. Many people think that if you are simply sitting in your car, and it is parked, that you are not \"operating\" a motor vehicle and therefore cannot be charged with DUI. This is not the case. The background of the case is that a man parked his car at an intersection and fell asleep at the wheel. A woman who lived near the intersection saw the man asleep at the wheel and called 911 concerned that he may be in some sort of medical trouble.
