In New Jersey You CAN Bike Drunk, But Not In Vermont
Each state has its own set of laws governing what types of vehicles are involved in DUI cases. In New Jersey it is only the operation of a motorized vehicle, while intoxicated, that will land you with a DUI charge. This includes vehicles such as cars, trucks, mopeds, motorcycles, ATVs, airplanes and dirt bikes. You can bike drunk, but that could lead to other charges such as public intoxication or disorderly conduct.
In Vermont, it is illegal to ride a bike while intoxicated. Vermont law states: Everyone riding a bicycle is granted all of the rights and is subject to all of the duties applicable to operators of vehicles, except as to those provisions which by their very nature can have no application.
