In New Jersey A Drunk Passenger's Seat Individual Can Be Charged With DUI
As crazy as it may sound, in New Jersey, if you are in a passenger seat and are intoxicated when an intoxicated driver is arrested, you may be too - for the same crime!
How is this possible? New Jersey law allows for it.
The main reason this law is used by prosecutors is in cases when the intoxicated owner of a vehicle is present and knowingly allows another intoxicated individual to drive their car. In a way, this makes sense. Someone doesn't want to drive drunk so they think they get around it by having another individual drive drunk. Not so fast! New Jersey says. You are driving drunk by proxy and we won't have it!
