Always Question The Integrity Of Testing Equipment - Defect Found
In Massachusetts, the company that manufactures the BAC testing equipment they use has begun an inspection of their devices following the discovery of a defect. The devices have two sensors that "balance and check" each other to make sure that there are no substances present that could alter an accurate reading. In the case of a discrepancy the device is supposed to shut down. Instead, the device, in many instances, failed to shut down and delivered a very inaccurate, over-the-top reading showing extreme intoxication. Even though the defect appears to have affected only fifteen or so of over 93,000 samples, the point is clear. It is imperative to investigate every possible defense when you are charged with a crime. Especially one that can restrict your freedoms as much as a DUI can.
